Dear Senator Theodore Orji,
RE: ABSENCE FROM SENATE VOTING SESSION ON ELECTORAL ACT AMENDMENT BILL
1.We, the Abia League of Professional Initiatives, wish to condemn in the strongest terms, the evident thwarting of the will of your constituents in Abia Central Senatorial Zone and indeed the will of the constituents of the other Senatorial Zones by the decision of the Senate of the Federal Republic of Nigeria, on the use of electronic transmission of election results in the Electoral (Amendment) Bill. The Senate’s decision can properly be seen as an anticipatory compromise of the electoral process, which is the bedrock of our representative democracy.
2.We are particularly dismayed that media reports indicate that you were absent from the Senate Chambers when this crucial vote was called. Given the scale of the public outcry against the impending passage of this provision in the Electoral Act, we consider your absence to be an egregious shirking of your responsibility and a dereliction of your duties as the representative of the people of Abia Central Senatorial Zone, whose voices were effectively silenced by your absence.
3.We note with concern that developments in Nigeria’s political firmament in the last few years have seen a progressive erosion of the will, aspirations of the people and a leaning towards autocratic governance. Ominously, the assault on the Nigerian constitution and the brazen impunity demonstrated by the political class will have dire consequences on our fledging democracy if left unaddressed. In this context, it is obvious to all that the unconstitutional provisions in the amendment of the Electoral Act, are yet another step in a plan to compromise the forthcoming 2023 General Elections.
4.This dangerous trajectory places huge responsibilities on the National Assembly, especially the Senate, in curtailing the excesses of the executive arm of the Federal Government. The implication is that national politics in Nigeria is no longer business as usual because these anti-democratic tendencies must be robustly resisted by all well-meaning and patriotic Nigerians. It should be a given that the South-east Zone, which has borne the brunt of the discriminatory and undemocratic actions of the Federal Government, should be at the forefront in defending key democratic institutions and accepted norms of democracy against the onslaught of the present administration.
5.The Southern Governors Forum has shown leadership in providing guidance to legislators from the South on specific legislative agenda items including how they should vote in the Electoral Act Amendment Bill, which in this particular case, is within the purview of the Independent Electoral Commission (INEC). Unfortunately, some southern Senators, including yourself decided to swim against the tide and work against the interests of the people they represent.
6.Your absence was a great embarrassment and a disservice to your constituents, who are your employers. The hallmark of democracy is government of “the people, by the people” and is defined by effective representation in the legislature, where elected representatives take on the responsibility of canvassing the needs and aspirations of their constituents through debates and votes.
7.We are by this letter, requesting for your formal written explanation of your action. We consider your action to be adequate grounds for initiating a formal Constitutional Recall process, in the event that your explanation is unsatisfactory.
However, given that a recall process in Nigeria, could be tedious and frustrating, we at ALPI will consult widely with other stakeholders in Abia State on the most effective way to hold you accountable, in the event that you offer no explanation or an unsatisfactory explanation for your action.
Public service is a sacred trust that demands accountability.
